A doctor who incorrectly performed a cosmetic surgery is facing a lawsuit from a former patient. The doctor, who performed an enhancement surgery for a 44-year-old New Jersey resident, is being hit with a medical malpractice suit after complications led to the patient contracting an infection. The suit encompasses both the doctor and his medical group at large.
According to court documents, the surgery was performed in 2009, and since then the patient has suffered considerable medical distress as a result. The surgery involved the insertion of a three-piece implant which the patient claims malfunctioned. The resulting infection worsened over the course of a year, leading to a great deal of pain and a necessary second surgery.
The doctor claims he advised the patient to have the implant removed, but that the patient neglected to take the necessary steps for several months. The patient has countered with the claim that the doctor demanded $10,000 to be paid in advance of removing the implant. The patient also alleges that a second surgery performed elsewhere left him with significant scarring and nerve damage. The doctor’s representation has dismissed these claims.
Medical malpractice is a serious charge — even a cosmetic surgery can have disastrous health-related consequences if it is not performed properly. A New Jersey resident experiencing complications from a surgery should seek medical assistance immediately. Should the complications be found to be the fault of a botched surgery, as may be the case here, it may be beneficial for the injured party to seek additional information about the specifics of filing a medical malpractice suit in a state court.
